Bail Under Murder Case: IPC 302

A petition is filed seeking regular bail in case FIR No.891/2014 under Section 302/34 IPC and 25 Arms Act registered at police station Ambedkar Nagar.

Learned counsel for the petitioner submits that since the petitioner is covered by High Powered Committee Guidelines dated 11.05.2021, hence he request that the petition be treated as petition seeking interim bail.

In the circumstances, the petition is treated seeking interim bail under the High Powered Committee Guidelines dated 11.05.2021 which says that under trial prisoners (UTPs) facing trial for offence under Section 302 IPC and are in jail for more than two years with no involvement in any other case can be considered for grant of interim bail for a period of 90 days. It is submitted by learned counsel for the petitioner that PW1 and PW3 – the father and the last seen witness have not deposed against the petitioner but whereas learned APP for the State submits that there was a recovery of a blood stained knife at the instance of the petitioner to which learned counsel for the petitioner says it was planted. Nevertheless learned counsel for the petitioner states at bar that the petitioner has no other involvement in any other case.

Justice Yogesh Khanna held that petitioner hereby granted interim bail for 90 days on executing a personal bond of Rs.20,000/-directed to furnish his contact details/address to the Investigating Officer and shall make video call to the Investigating Officer in the first week of every month and shall keep his mobile location app open at all time. The petitioner will not contact or threaten the witnesses in any manner, lest it shall be a ground for cancellation of bail.
