A petition was filed on behalf of one our client with a prayer to allow the a following Writ Petition, to issue Writ in the nature of Mandamus granting the release/extension of parole to the petitioner in case FIR No 67/99 PS Keshav Puram & FIR No 68/99 PS Mukherjee Nagar for a period of sixty days in order to enable the petitioner to get proper treatment and to dispose off his ancestral property and to rebuild ties with the society and to build up a home for himself after to reside in after serving his sentence.
Opposite Counsel argued that an order dated 07.01.2021 specified that the petitioner shall positively surrender on 21.01.2021 and shall not file any extension application for parole, but yet again, the present petition has been filed along with a certificate of doctor from Safdarjung Hospital, New Delhi stating inter alia the petitioner has tested Covid positive on 17.01.2021 and is prescribed home quarantine for 14 days.
Justice Yogesh Khanna held that the the interim parole of petitioner stands extended till 01.02.2021 i.e. for 14 days from 17.01.2021 and the petitioner shall positively surrender on 02.02.2021.
Petition stands disposed.
